(1) Except as otherwise provided in subsection (2) of this section, in addition to any other sanction or remedial procedure that may be available, the person in charge is subject to a penalty of up to $500.00 per day from the date the notice of declaration of chronic nuisance issued, until the chief law enforcement officer confirms that the property is no longer a chronic nuisance property.

(2) If the agreed course of action results in the abatement of nuisance activities to the satisfaction of the chief law enforcement officer within thirty days of the notice of declaration of chronic nuisance, or such longer period allowed by the chief law enforcement officer pursuant to §12.03A.030(1), above, the matter shall not be referred to the Town Council and the person in charge shall not be subject to any penalty pursuant to this Chapter.

(3) An owner who fails to comply with §12.03A.035 (the “Owner Cooperation” section, above) is subject to a civil penalty of up to $500.00. (Ord. 419-N, §1, 2012)
