(1) Burning rules within the Town of Garfield shall be recommended by the Chief of the Town Fire Department and approved by the Town Council.

(2) Burning times shall be set by the Town Fire Department Chief. Burning will be restricted to times of low fire risk conditions.

(3) Basic burning rules will be as listed below but the Chief may add additional requirements as needed on specific burns in order to ensure public safety.

(a) Burning will be done only by applicants who have obtained a burning permit from the Chief.

(b) All burning must be done in a safe area without risk to adjacent properties. Burning may not cause risk to persons or animals.

(c) The burning permit applicant is totally responsible for the safety of the burn and will be held accountable for any and all damages caused by the burn in the event of property damage to their own property, damage to property of others, injury to others, injury to animals, and the cost of fire suppression, if needed.

(d) All fires must be monitored by at least one person at all times until the fire is extinguished. This person must have the ability to control the fire, be at least 18 years of age, have in their control enough water to extinguish the fire, and must also have in their control a shovel.

(e) All flammable material must be removed from the ground around the burn area. This ring around the fire should be at least the width of one half the width of the fire area.

(f) Burning may only be done during daylight hours.

(g) The Chief may cancel a burn permit at any time if weather or fire conditions warrant. The Chief may also require that a legal burn be extinguished if conditions so dictate.

(h) Burning must comply with any Federal, State, or County laws that may apply.

(i) Except for Fire Department Training Burns, only vegetative materials that meet the rules of the State of Washington may be burned.

(4) In the event the Fire Department provides emergency stand-by for a permitted burn, the permit holder will still be liable for any and all damages in the event of damage as described in item 3, above.

(5) If the Fire Department conducts a training exercise burn, they will comply with all Labor and Industry regulations concerning such training. In the event of a training exercise burn, the permit applicant will be the Fire Department and the property owner. (Ord. 273-N, §2, 2000)
