No dog meeting the definition of a dangerous or potentially dangerous dog as defined in GMC 8.02.011 shall be kept, harbored, or present at any time within the Town of Garfield. At all times during the pendency of any legal proceeding upon a complaint or citation alleging a violation of this section, the dog in question shall either be removed from the Town, or impounded by the Town. The cost of keeping any dog impounded under this section shall be assessed to the owner or keeper of the dog if the dog is adjudged a dangerous or potentially dangerous dog; otherwise, the Town shall bear the cost.
