(1) The rates charged by the grantee for services to subscribers to its CATV system shall be fair and reasonable. No monthly charges for extra outlets shall be charged, except for extra installation fee and amplifier deposit, if required. GRANTEE SHALL NOTIFY THE TOWN COUNCIL IN WRITING OF ANY RATE INCREASE NO LESS THAN 60 DAYS PRIOR TO THE EFFECTIVE DATE OF THE INCREASE.

(2) Should a potential subscriber desire a cable outlet in his or her home or business, the Grantee shall furnish up to 200 feet of hookup cable and associated terminal equipment for the standard installation charge. Any additional cable or associated hookup equipment or amplifiers will be paid by the subscriber as an additional charge.

(3) The Town reserves the right to regulate the rates charged by the Grantee for its services should the Town Council, for any reason, deem it necessary. Should the Town assume rate regulation, no action shall be taken by the Town Council with respect to the rates until after 30-days public notice, and until after the Grantee has been given an opportunity to be heard by the Council with regard to rates.

(4) By its acceptance of this franchise, Grantee specifically agrees that its rates and charges to its subscribers for television, radio signals, or other related services, shall be fair and reasonable and consistent with consideration of the Town and the entitlement of a commercial enterprise to a reasonable return for its risk, services, and investment.

(5) The grantee shall receive no consideration whatsoever for its services except as provided in this Chapter. (Ord. 258-N, §1, 1998)
