It shall be unlawful within the Town of Garfield to disturb the public peace. For the purposes of this chapter, a person shall be guilty of disturbing the public peace if, within the Town of Garfield:

(1) such person intentionally operates any mechanical or electronic sound amplification device, thereby causing to be emitted therefrom a loud and raucous volume of sound from which an unwilling listener has no reasonable method of protection, or

(2) such person intentionally and knowingly permits another person to operate any mechanical or electronic sound amplification device over which such person has actual physical control and possession, thereby causing to be emitted therefrom a loud and raucous volume from which an unwilling listener has no reasonable protection.

For the purpose of this section, a “mechanical sound amplification device” shall include, for example, horns and sirens, and an “electronic sound amplification device” shall include, for example, radios, stereos, tape or compact disc player. (Ord. 261-N, §1, 1998; Ord. 93-N, §2, 1977)
