(1) Any user who violates the following conditions is subject to having the privilege of discharging to the public sewer system withdrawn:

(a) Discharge of nondomestic wastewater without a permit, including:

(i) Where the appropriate permit has not been requested;

(ii) Where the appropriate permit has not yet been issued; or

(iii) Where the permit has been denied or revoked.

(b) Violation of permit terms and conditions, including:

(i) Exceeding any permit limit;

(ii) Failing to meet other pretreatment standards or requirements;

(iii) Violating any prohibition; or

(iv) Failing to properly monitor and report discharges or changed conditions.

(c) Refusal of reasonable access to the user’s premises for the purpose of inspection, monitoring, or sampling (whether subject to a permit or not); or

(d) Violation of the pretreatment standards and requirements in Article II of this chapter, including failure to satisfy industrial user survey requirements.

(2) When the Public Works Superintendent determines this remedy is necessary and appropriate to fulfill the intentions of this chapter, such user will be notified of the proposed termination of its discharge and be offered an opportunity to show cause under GMC 12.16.350 why the proposed action should not be taken. Exercise of this option by the Public Works Superintendent shall not be a bar to, or a prerequisite for, taking any other action against the user. (Ord. 445-N, §1, 2014)
