(1) Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the Chapters of the Town shall be guilty of a civil infraction. All offenses under the Garfield Municipal Code shall be considered a non-criminal, civil infraction. Notwithstanding provisions in the Garfield Municipal Code to the contrary, no person shall be guilty of a misdemeanor as a result of a violation of any provisions of the Garfield Municipal Code.

(2) Any person convicted of a civil infraction under any Chapter of the Town of Garfield, or any provisions of the Garfield Municipal Code, shall be punishable by a fine of not more than five hundred dollars ($500.00), or by commitment to public service within the Town of Garfield not to exceed two hundred fifty total hours (250), or by both such fine and public service, except in cases where a different civil penalty is prescribed by such Chapter or provision of the Garfield Municipal Code.

(3) A person is guilty of a separate offense for each day or portion of a day in which a violation of any provision of the Chapters of Garfield is committed, continued or permitted by any such person, and any such person shall be punished accordingly. (Ord. 247-N, 1996)
